Distance Sales Contract
ARTICLE 1 – PARTIES
1.1 – SELLER:

1.2 – BUYER:
The person who is a registered member of the shopping website bemutr.com as a customer. The address and contact information provided during registration are considered valid.
ARTICLE 2 – SUBJECT
The subject of this contract is to determine the rights and obligations of the parties in accordance with the provisions of the Law No. 4077 on the Protection of Consumers and the Regulation on Distance Contracts regarding the sale and delivery of the product(s), the characteristics and sales price of which are specified below, ordered electronically by the BUYER from the website bemutr.com owned by the SELLER.

ARTICLE 4 – GENERAL TERMS
4.1 – The BUYER declares that they have read and been informed of the basic features of the product, its sales price, payment method, and delivery terms on the website of BEMU, and has confirmed this electronically.
4.2 – The product subject to this contract will be shipped to the BUYER or to the person/institution at the delivery address indicated by the BUYER within the legal period of 10 business days, unless otherwise stated.
4.3 – If the product is to be delivered to someone other than the BUYER, the SELLER cannot be held responsible if the recipient refuses the delivery.
4.4 – The SELLER is responsible for delivering the product complete, undamaged, and in accordance with the characteristics specified in the order.
4.5 – For the delivery of the product, this contract must be signed and received by the SELLER, and the payment must be completed using the BUYER’s selected payment method. If the product price is not paid or the transaction is canceled in bank records for any reason, the SELLER is not obligated to deliver the product.
4.6 – If, after delivery, the BUYER’s credit card is used unlawfully or by unauthorized persons (through no fault of the BUYER), and the related bank or financial institution does not pay the product price to the SELLER, the BUYER must return the delivered product to the SELLER within 3 days. In this case, the shipping cost belongs to the BUYER.
4.7 – If the SELLER cannot deliver the product on time due to force majeure (natural disasters, adverse weather, transportation disruptions, etc.), they must notify the BUYER.
ARTICLE 5 – RIGHT OF WITHDRAWAL
5.1 – Due to Turkish customs regulations, any returned package is considered an import shipment. This process often triggers customs duties, taxes, and handling fees, which can amount to 2–3 times the original value of the product. For this reason, BEMU is unable to accept returns.
5.2 – The BUYER is encouraged to carefully review product descriptions, measurements, colors, and images before placing an order to ensure the product meets their expectations.
5.3 – Exceptions: In the rare event that a product is defective, damaged during shipment, or incorrect, the BUYER must contact BEMU at bybemu@gmail.com within 5 days of receiving the order and provide photos of the issue. Each case will be evaluated individually, and an appropriate solution will be offered.
5.4 – CUSTOM ORDERS: Products made or personalized upon the BUYER’s request (e.g., custom prints, custom sizes) cannot be returned or exchanged.
ARTICLE 6 – NON-RETURNABLE ITEMS EVEN IF DUE TO SELLER FAULT
The right of withdrawal cannot be used for the following items:
- Washed products
- Worn products
- Products that have absorbed odors
- Products with removed tags
- Products that are no longer resalable for any reason
ARTICLE 7 – CUSTOMS AND INTERNATIONAL ORDERS
International orders may be subject to customs duties, taxes, or other fees imposed by the buyer’s country. These charges are the responsibility of the BUYER and are not refundable by the SELLER.
ARTICLE 8 – COMPETENT COURT
In the implementation of this contract, the Consumer Arbitration Committees and Consumer Courts located in the place of residence of the BUYER or SELLER have jurisdiction up to the value announced by the Ministry of Industry and Trade.
By completing the order, the BUYER is deemed to have accepted all the terms of this contract, including the no-return policy in accordance with Turkish customs regulations.
